Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Truth or Pulse application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Truth or Pulse ("we", "our", or "us").

2. Eligibility

To use Truth or Pulse, you must:

  • Be at least 13 years of age
  • If you are between 13 and 18 years old, have permission from a parent or legal guardian
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. How Truth or Pulse Works

Truth or Pulse is a social game where users:

  • Send "Pulses" (sets of questions) to friends
  • Record video responses to questions they receive
  • Have their heart rate displayed during recording (with permission)
  • Share and view responses with friends

Important: The heart rate feature is for entertainment purposes only. Truth or Pulse is not a medical device, lie detector, or diagnostic tool. Heart rate readings should not be used to make any conclusions about truthfulness, health, or medical conditions.

5. User Content

Your Content

You retain ownership of the content you create (videos, questions, profile information). By sharing content through the App, you grant us a limited, non-exclusive, royalty-free license to:

  • Host, store, and display your content to your intended recipients
  • Process and transmit your content as necessary to operate the App

UGC Sharing (Optional)

If you opt in to our User Generated Content (UGC) sharing feature, you grant Truth or Pulse permission to:

  • Download and edit your content for length and format
  • Share your content on official Truth or Pulse social media accounts
  • Credit you with attribution when sharing

You can revoke UGC consent at any time through Settings, which applies to future content only.

Content Responsibility

You are solely responsible for the content you create and share. We do not endorse or guarantee the accuracy of any user content.

6. Prohibited Conduct

You agree NOT to:

  • Harass, bully, threaten, or intimidate other users
  • Post content that is illegal, obscene, defamatory, or violates others' rights
  • Share content depicting or exploiting minors in any harmful way
  • Impersonate another person or entity
  • Use the App for any illegal purpose
  • Attempt to circumvent security features or access unauthorized areas
  • Use automated systems, bots, or scripts to access the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for commercial purposes without our consent
  • Spam or send unsolicited content to users
  • Upload viruses or malicious code

Violation of these rules may result in immediate account termination.

7. Health Data and HealthKit

If you choose to connect Apple HealthKit:

  • Heart rate data is used solely for the in-app entertainment feature
  • We do not use health data for advertising or marketing
  • We do not sell health data to third parties
  • You can revoke access at any time through device Settings

8. Intellectual Property

The App, including its design, features, code, graphics, and branding, is owned by Truth or Pulse and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

9. In-App Purchases and Subscriptions

Truth or Pulse may offer in-app purchases or subscriptions. By making a purchase:

  • You agree to pay all applicable fees
  • Purchases are processed through Apple's App Store
  • Refunds are subject to Apple's refund policies
  • Subscriptions automatically renew unless cancelled before the renewal date

You can manage subscriptions through your Apple ID settings.

10. Account Termination

By You

You may delete your account at any time through the App (Profile → Settings → Account → Delete Account). Upon deletion:

  • Your profile and personal data will be deleted
  • Content you've sent to others may remain visible to them
  • Deletion is permanent and cannot be undone

By Us

We may suspend or terminate your account at our sole discretion, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users or the App.

11. Disclaimers

The following disclaimers apply to the maximum extent permitted by law:

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or secure.
  • Heart rate data is for entertainment only. We make no claims about accuracy or correlation to truthfulness, emotions, or medical conditions.
  • We are not responsible for user content or interactions between users.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Truth or Pulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater
  • We are not liable for any harm resulting from user content, user interactions, or reliance on heart rate data

13. Indemnification

You agree to indemnify and hold harmless Truth or Pulse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

14. Dispute Resolution

If you have a dispute with Truth or Pulse:

  1. Contact us first: Email support@truthorpulse.com to try to resolve the issue informally
  2. Binding arbitration: If we cannot resolve the dispute, you agree to binding arbitration rather than court proceedings (except for small claims court)
  3. No class actions: Disputes must be resolved individually, not as part of a class action

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Delaware.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting a notice in the App
  • Sending you a push notification or email
  • Updating the "Last updated" date above

Your continued use of the App after changes constitutes acceptance of the updated Terms.

17. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Truth or Pulse.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms. We may assign our rights without restriction.
